Overview
Welcome to Redgum Vault.
The terms "we", "us" and "our" refer to Redgum Vault. We operate this website and online store to provide our customers with access to trading cards, collectibles, games, accessories and other products and services (the "Services").
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service ("Terms"), together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies referenced on our website, govern your access to and use of the Services.
By accessing or using the Services or placing an order with us, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable law.
1. Access and Accounts
You must provide accurate, current and complete information when creating an account, placing an order or otherwise using the Services.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You must notify us if you believe your account has been accessed or used without authorisation.
We may restrict or terminate access to an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
2. Products and Product Information
We make reasonable efforts to ensure product descriptions, images, prices, availability and other information displayed on our store are accurate.
Colours and appearance may vary depending on your device, display settings, lighting and photography.
For trading cards, comics, graded cards and other collectibles, condition can involve a degree of reasonable subjective assessment. Where an item is individually photographed, those photographs form an important part of the product description and should be reviewed before purchasing.
Minor manufacturing variations may occur in sealed or mass-produced products.
We reserve the right to correct genuine errors in product descriptions, pricing, images, inventory or other information.
Nothing in this section limits your rights under the Australian Consumer Law where goods are faulty, damaged, materially different from their description or otherwise fail to comply with applicable consumer guarantees.
3. Trading Cards, Collectibles and Sealed Products
Trading cards and collectibles may vary naturally in centring, print quality, surface, edges, corners and other manufacturing characteristics.
Unless expressly stated otherwise, we do not guarantee that an ungraded card will receive any particular grade from PSA, CGC, Beckett or any other grading service.
Any estimated condition or condition description provided by Redgum Vault is our assessment of the item and is not a guarantee of a particular third-party grade.
For professionally graded products, the grade displayed is the grade assigned by the identified grading company.
The contents of sealed trading card products are determined by their respective manufacturers. Redgum Vault does not guarantee particular cards, rarities, pull rates, values or other contents unless expressly stated in the product description.
Opening a sealed product because its contents or pulls are unwanted does not make the product faulty.
Nothing in this section limits rights available under the Australian Consumer Law.
4. Orders
Placing an order constitutes an offer to purchase the products in your order.
An automated order confirmation acknowledges that we have received your order but does not necessarily constitute final acceptance where there is a genuine pricing, inventory, payment, fraud-prevention or other material error.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- an inventory error has occurred;
- an obvious pricing or listing error has occurred;
- payment cannot be successfully processed;
- we reasonably suspect fraud or unauthorised payment activity;
- an order exceeds an applicable purchase limit; or
- accepting the order would breach applicable law.
If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.
Please review your order carefully before submitting it. Once an order has entered processing or dispatch, we may not be able to change or cancel it.
Returns and refunds are handled in accordance with our Returns & Refund Policy and your rights under Australian Consumer Law.
5. Pricing and Payment
Unless otherwise stated, prices displayed on our Australian store are in Australian dollars (AUD).
Applicable shipping charges will be displayed during checkout before you complete your purchase.
Where GST is applicable, prices will be displayed and handled in accordance with Australian law.
Prices, promotions and discounts may change from time to time.
If a product is listed at an obviously incorrect price because of a genuine error, we may contact you to offer the opportunity to purchase at the correct price or cancel and refund the affected item.
You must provide accurate and authorised payment information when placing an order.
6. Shipping and Dispatch
Orders are shipped according to the dispatch information and estimated timeframes displayed on our website and during checkout where applicable.
Delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.
Redgum Vault operates around a FIFO work schedule. At certain times, orders may continue to be accepted while dispatch is temporarily paused. Where this occurs, we will make reasonable efforts to clearly display the applicable dispatch notice and expected resumption date before purchase.
Customers should review any dispatch notices displayed on the website or during checkout before placing an order.
Once an order has been dispatched, delivery may be affected by postal or courier delays outside our reasonable control. We will nevertheless provide assistance where reasonably required and comply with our obligations under Australian Consumer Law.
Nothing in these Terms transfers risk or otherwise limits rights in a manner prohibited by applicable Australian law.
7. Preorders
Products offered for preorder may have estimated release or delivery dates supplied by manufacturers, distributors or publishers.
These dates may change for reasons outside Redgum Vault's control.
Where a preorder allocation is reduced, cancelled or cannot reasonably be fulfilled, we will contact affected customers and provide an appropriate refund for products we cannot supply.
Unless expressly stated otherwise, ordering a preorder product does not guarantee a particular manufacturer release date.
Additional preorder-specific conditions may be displayed on individual product pages and form part of these Terms.
8. Returns, Refunds and Consumer Guarantees
Change-of-mind returns are governed by our Returns & Refund Policy.
Goods sold by Redgum Vault come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Where goods fail to comply with an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and whether the failure is major or minor.
Our voluntary return policies operate in addition to these rights and do not replace or restrict them.
9. Intellectual Property
The Redgum Vault name, logo, branding, website design, original graphics, photographs, written content and other original materials created by or for Redgum Vault remain the intellectual property of their respective owners and may not be reproduced or commercially exploited without permission.
Third-party trademarks, product names, characters, artwork and other intellectual property displayed in connection with products remain the property of their respective owners.
The sale of third-party products by Redgum Vault does not imply sponsorship, endorsement or affiliation with the relevant intellectual property owner unless expressly stated.
10. Third-Party Services and Links
Our Services may include tools, applications, payment services, integrations or links provided by third parties.
Those services may be governed by their own terms and privacy policies.
We are not responsible for third-party websites or services that are outside our reasonable control.
Nothing in this section excludes liability that cannot lawfully be excluded.
11. Relationship with Shopify
Redgum Vault is powered by Shopify, which enables us to provide the Services to you.
Sales made through our store are transactions between you and Redgum Vault. Shopify provides the ecommerce platform and related services supporting those transactions.
Your use of Shopify functionality may also be subject to applicable Shopify terms and privacy practices.
12. Privacy
Our collection, use and disclosure of personal information is described in our Privacy Policy.
Because our store is hosted by Shopify, certain information is also processed by Shopify and other service providers necessary to operate our store, process transactions and provide the Services.

13. Reviews, Feedback and User Content
If you submit a product review, photograph, comment or other content to Redgum Vault, you confirm that you have the right to provide that content and that it does not unlawfully infringe another person's rights.
You grant Redgum Vault a non-exclusive, worldwide, royalty-free licence to display and use content you intentionally submit for review, feedback, promotional or store-related purposes, subject to applicable privacy law.
We may remove content that is unlawful, fraudulent, abusive, misleading, spam, unrelated to the product or otherwise inappropriate for our Services.
We will not remove or alter legitimate reviews merely because they express a negative opinion about Redgum Vault or a product.
14. Prohibited Uses
You must not use the Services:
- for unlawful or fraudulent purposes;
- to interfere with the security or operation of the website;
- to distribute malicious software;
- to obtain unauthorised access to accounts, systems or information;
- to scrape, harvest or collect personal information unlawfully;
- to impersonate another person;
- to infringe intellectual property or other legal rights;
- to conduct fraudulent payment activity, chargeback abuse or other deceptive activity; or
- in any way that materially interferes with another person's legitimate use of the Services.
We may restrict access to the Services where reasonably necessary to protect Redgum Vault, our customers or our service providers.
15. Automated Systems and Agents
Automated systems, bots or AI agents must not access or interact with the Services in a manner that circumvents security controls, rate limits, CAPTCHAs, robot exclusion measures or other reasonable technical restrictions.
We may restrict automated access where reasonably necessary to protect the security, stability or commercial operation of the Services.
16. Errors and Availability
Occasionally, our website may contain typographical errors, incorrect inventory information, pricing errors or other inaccuracies.
We may correct genuine errors and update information when discovered.
If an error materially affects an order that has already been placed, we will contact you where reasonably practicable and provide an appropriate solution, including a refund where we cannot fulfil the order.
17. Limitation of Liability
To the maximum extent permitted by law, Redgum Vault is not liable for losses that are indirect, consequential or not reasonably foreseeable as a result of your use of the Services.
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law.
Where our liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
18. Indemnity
To the extent permitted by law, you agree to indemnify Redgum Vault against reasonable losses or liabilities arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights.
This provision does not require you to indemnify Redgum Vault for losses caused by our own unlawful conduct, negligence or breach of applicable consumer law.
19. Suspension and Termination
We may suspend or terminate access to the Services where we reasonably believe you have materially breached these Terms, engaged in fraudulent or unlawful conduct, or created a material security risk.
Termination does not affect rights or obligations that arose before termination.
20. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will continue to operate.
21. Entire Agreement
These Terms and the policies incorporated into them constitute the agreement governing your use of the Services and purchases from Redgum Vault, subject always to rights that cannot lawfully be excluded.
22. Governing Law
These Terms are governed by the laws of Western Australia, Australia, and applicable Commonwealth laws of Australia.
Subject to any rights you have to bring proceedings elsewhere under applicable consumer law, disputes relating to these Terms are subject to the jurisdiction of the courts and tribunals of Western Australia and applicable Australian federal courts.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
The current version will be published on our website with an updated effective date.
Changes will not retrospectively remove rights that have already arisen under an existing purchase or applicable law.
